Uninsured Driver Claims

Having a road traffic accident is a horrible enough experience to go through on its own but having a road traffic accident that was caused through a negligent driver with no insurance takes things to a whole new level.

It has been said that one in 20 motorists regularly drive without insurance and one in 10 motorists have fallen victim to an accident involving an uninsured driver. It is because of uninsured drivers and the accidents that they cause that insurance premiums have been pushed to their highest, making you, the victim, being the one who ends up paying the price.

UK law surrounding the punishment of uninsured drivers is being cracked down on so that uninsured drivers will be made to pay a fee of £100 and their car will be seized and crushed, this is the plan that will replace the current £170 fine.

If you are unfortunate enough to become the victim of an accident with an uninsured driver you are highly unlikely to know at the time of the accident that the driver is uninsured. This is why it is so important that you get as much detail from the driver as you can, even if it does turn out to be false.

You should take down:

  • The drivers name and address
  • The make, model and registration plate number of the car
  • Make a note of any other details that the driver provides you with
  • Record the damage done to the other car as well as the scene of where the accident happened
  • Make a note of any road signs, road marking and light and weather conditions
  • If you are lucky enough to have a witness to the accident you should get a statement from them and take down their contact details as well
  • Take photographs of the scene if possible

Running the drivers registration plate through the DVLA will determine whether or not the driver was insured. If it turns out that they weren’t you should inform the police and your insurance company. You should also fill in a form from the Motor Insurance Bureau (MIB). The MIB was established in 1946 as a way of victims of negligent and uninsured drivers to claim compensation.
